TOKYO, Jan. 31, 2011 /PRNewswire/ -- NTT Communications (NTT Com) announced on January 31 that with assistance from Hong Kong-based NTT Com Asia, the company plans to launch the Asia Submarine-cable Express (ASE), a 40-gigabit-per-second (Gbps) undersea cable, in June 2012. The ASE eventually will connect major business hubs across East Asia via some 7,200 kilometers of cable, and boast a total carrying capacity exceeding 15 terabits per second.
The ASE is being constructed by NTT Com, Malaysia-based Telekom Malaysia, Philippines-based PLDT and Singapore-based StarHub. Total cost of construction is estimated at approximately 430 million USD (about 36 billion yen).
When it initially starts operating, the ASE will serve Japan, Malaysia, Singapore and the Philippines. A separate route to Hong Kong will be added in December 2012. Connections to Mainland China and additional Southeast Asian countries are expected to be launched in collaboration with major carriers in these markets.
Incorporating the latest 40 Gbps optical technology, the ASE will boost the capacity and strengthen the redundancy of NTT Com's Asian cable networks, paving the way for enhanced global network services that will meet the region's increasing needs for global traffic, low network latency and reliability. The ASE also has a capability to incorporate 100 Gbps optical technology in the future.
The ASE will be specially designed to withstand earthquakes and typhoons, particularly in areas such as the Bashi Channel south of Taiwan, where undersea earthquakes have disrupted international communications in the past few years. Routes between Japan, Hong Kong and Singapore will cover the shortest possible distances to maximize reliability and minimize latency.

Overstock.com Applauds Federal Court Decision Halting Enforcement of Colorado Internet Tax Law
Court finds: "likelihood of success" in claims that the CO law is unconstitutional.
SALT LAKE CITY, Jan. 28, 2011 /PRNewswire/ -- Overstock.com, Inc. (Nasdaq: OSTK) (short cut: O.CO) today applauded the decision by a Federal Court in Colorado enjoining the enforcement of Colorado's new "internet tax notice" law.
The controversial law, enacted in 2010, required out-of-state retailers to publish to Colorado purchasers a notice telling them of their obligation to pay Colorado "use" taxes on their purchases.
The law also required retailers to report these transactions to the Colorado Department of Revenue at year's end, and to tell Colorado purchases at year's end of their obligations to pay and that the retailers were providing purchase information to the Colorado tax authorities.
"We not only thought the Colorado law was a huge invasion of customer privacy," said Jonathan Johnson, President of Overstock.com, "but that the law clearly violated the U.S. constitution by plainly discriminating against out-of-state retailers. Other state legislatures considering copycat legislation should take note that this type of law is not legal."
The case was brought by the Direct Marketing Association, a membership organization consisting of companies who market products across state lines by mail and through the internet.
The court's injunctive decision cites constitutional grounds as the basis for its order, noting the Colorado law's discriminatory effect on out-of-state retailers--those the law targeted for compliance. The law was heavily lobbied in the waning days of the last legislature by local brick-and-mortar retailers.
The court buttressed its ruling by citing to long-standing decisions by the U.S. Supreme Court supporting the principal that a state may not impose on out-of-state retailers burdens not imposed similarly on in state retailers. Citing these decisions, the court observed that "out-of-state retailers that do not have a physical presence in Colorado generally are not obligated to collect and remit sales tax on their sales in Colorado."
The new Majority Leader of the Colorado House of Representatives, Amy Stephens was swift to endorse the court's ruling. Majority Leader Stephens stated: "Unfortunately, this tax proposal was rushed through the legislature, causing concern for consumers and leading to the immediate loss of Colorado jobs." Stephens added she would later be introducing a measure to repeal the entire law in an effort to recover the jobs lost.
Overstock.com noted that the efforts to impose on out-of-state internet retailers tax collection obligations began in 2008, when New York passed a law that made doing business with New York's internet advertisers a basis to force out-of-state retailers to collect sales tax. It backfired: Overstock.com and other retailers reacted by terminating contracts with New York advertisers and Overstock.com sued in New York state court.
Although a New York trial court ruled in favor of the state, the company is confident that it will ultimately succeed and has pressed on through appeals, citing the Supreme Court cases as were relied upon by the U.S. District Court in its decision yesterday. Ultimately, Overstock.com believes that when Federal Courts examine the question, all these types of laws will be found unconstitutional.

(Nasdaq: TMRK) today announced a definitive agreement under which Verizon will acquire Terremark, a global provider of managed IT infrastructure and cloud services, for $19.00 per share in cash, or a total equity value of $1.4 billion.
Pursuant to the agreement, Verizon anticipates that it will commence a tender offer between Feb. 10, 2011, and Feb. 17, 2011, for all shares of common stock of Terremark. The tender offer price constitutes a premium of 35 percent per share over today's closing price. The transaction is subject to the valid tender of a majority of the shares of Terremark; the expiration or early termination of the Hart-Scott-Rodino antitrust waiting period; and other customary closing conditions. The Board of Directors of Terremark has unanimously approved the transaction, and the transaction was unanimously approved by the directors of Verizon present and voting. Verizon has also entered into agreements with three stockholders of Terremark to tender their shares into the offer, representing approximately 27.6 percent of the outstanding voting shares of Terremark. Verizon expects to close the tender offer late in the first quarter of 2011.
This transaction will accelerate Verizon's "everything-as-a-service" cloud strategy by delivering a powerful portfolio of highly secure, scalable on-demand solutions to business and government customers globally through a unified enterprise IT platform and unique business cloud offerings that leverage the companies' collective strengths.

TALLAHASSEE, Fla. Jan. 27, 2011 /PRNewswire/ -- For R.C. Hill, owner of R.C. Hill Mitsubishi in Deland, Florida, a new tool for automobile dealers has already proven effective for after-hours shoppers. Hill is the owner of a Florida dealership currently testing a new product from Auto Data Direct (ADD) that utilizes a Quick Response Code on a scannable sticker affixed to the car. The sticker allows the consumer to access key vehicle data, even when the dealership is closed.
In 2010 ADD applied for a patent on its revolutionary new product that allows consumers with a smartphone to scan a QR code sticker using a free code-reader application and instantly view a vehicle history report with data from the National Motor Vehicle Title Information System (NMVTIS). The report includes critical data from states, insurance carriers, junk and salvage entities used to help protect consumers from purchasing a damaged vehicle without knowledge of the vehicle's history. Data obtained from participating states helps prevent fraudulent activities such as Vehicle Identification Number (VIN) cloning and title washing. Stemming from The Anti Car Theft Act of 1992, NMVTIS is a U.S. Department of Justice database that currently contains 87% of all U.S. Department of Motor Vehicle data.
Through links provided with the report, dealers can guide consumers directly to their website and provide additional details such as price, photos, dealership hours and other information necessary to help the consumer make a purchase decision.
